Harvey A. Silverglate is counsel to Boston’s Zalkind Duncan & Bernstein LLP, specializing in criminal defense, civil liberties, and academic freedom/student rights law. He is cofounder and member of the board of directors of FIRE (Foundation for Individual Rights in Education), and he wrote the "Freedom Watch" column for the fabled Boston Phoenix “alternative weekly” newspaper until it ceased publication in 2013. His work has appeared in the National Law Journal, the Wall Street Journal, the New York Times Book Review, the Boston Globe, and elsewhere. Silverglate is co-author of The Shadow University with Alan Charles Kors.

Many of the solutions proposed for fix the judicial system seem simple. Unfortunately, since so many of our legislators are also attorneys and former prosecutors, am not hopeful they will even consider holding those in their profession accountable. This has resulted in a judiciary where political influence and bribery now have a strong hold.
The only true remedy may await greater public oversight. Unlike every other profession, lawyers are the only group solely possessing oversight of themselves. Be they legal counsel, prosecutors, or judges, there is no independent oversight from outside the profession. Doctors have oversight from medical boards within the profession and lawyers in the civil and criminal courts. If lawyers are going to police themselves, there must be serious and immediate penalties for any violations.
